  • Immediately reporting any unauthorized access to your account.

3.3 Data Privacy & Confidentiality

Kolabrya does not sell, share, or monetize user data. Your data is processed only to provide Services. We do not use user data to train AI models.

  • User data is stored within Microsoft Azure data centers and complies with applicable data protection laws.

  • You retain ownership of all data you upload to Kolabrya.

4. Payment & Subscription Terms

  • Users must read and understand the full service description before purchasing any Services.

  • Fees for the Services, including taxes and transaction fees, will be charged monthly to your selected payment method.

Refund & Cancellation Policy:

  • Users may cancel renewal of a subscription at any time before the expiration of the current service term.

  • No refunds are issued for Services already provided.

5. AI Disclaimer & User Responsibility

Kolabrya utilizes AI-driven technologies to generate summaries, insights, and reports.

  • AI-generated content may contain errors or omissions.

  • Users must independently verify all AI-generated outputs before relying on them for legal, professional, or business decisions.

  • Kolabrya assumes no liability for decisions based on AI-generated outputs.

By using our Services, you accept full responsibility for any reliance on AI-generated content.

6. Ownership of Intellectual Property

All content and materials within Kolabrya, including but not limited to:

  • Software, algorithms, AI models

  • Logos, graphics, trademarks

  • Text, images, videos, and all intellectual property

are the exclusive property of Kolabrya and may not be copied, distributed, modified, or used without explicit written permission.

7. User Account Suspension & Termination

Kolabrya reserves the right to immediately suspend or terminate your account if:

  • You violate these Terms or applicable laws.

  • Your account is involved in fraudulent, abusive, or unauthorized activities.

  • Your use of the Services poses a security risk to Kolabrya or its users.

Users may request account cancellation at any time. However, paid subscriptions will continue until the end of the billing period.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kolabrya, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from:

  • Your use of the Services.

  • Any violation of these Terms.

  • Any reliance on AI-generated outputs.

This indemnification obligation survives termination of your use of the Services.

9. Limitation of Liability

To the maximum extent permitted by law, Kolabrya is not liable for:

  • Indirect, incidental, punitive, or consequential damages, including loss of profits, data, goodwill, or business interruption.

  • Personal injury or property damage resulting from access to or use of the Services.

  • Unauthorized access to user data, despite reasonable security measures.

Kolabrya’s total liability in any case is limited to the amount paid by you for the Services in the last 12 months.

10. Modifications to These Terms

Kolabrya reserves the right to update or modify these Terms at any time.

  • Material changes will be notified through the Website or by email.

  • Continued use of the Services after modifications constitutes acceptance of the new Terms.

  • If you disagree with the new Terms, you must stop using the Services immediately.

By using Kolabrya, you consent to receive service-related communications, including:

  • Security updates.

  • Account-related notifications.

  • Promotional emails, unless you opt out.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of California, US without regard to conflict-of-law principles.

  • All disputes shall be resolved exclusively in Toronto, Ontario.

  • The United Nations Convention on Contracts for the International Sale of Goods does not apply.

  • Users waive any right to participate in class-action lawsuits against Kolabrya.
